Terms & Conditions
These Terms & Conditions apply to purchases, commissions, and other orders placed with Rexach Studios. They are intended to provide a clear understanding of the ordering, production, payment, delivery, and ownership process associated with our work.
Whether purchasing for a private residence, specifying work for a project, or collaborating with the studio on a custom piece, placing an order with Rexach Studios constitutes acknowledgment and acceptance of the following terms.
Orders, Deposits & Payments
Due to the made-to-order and handcrafted nature of our work, production begins only after any required deposit or payment has been received and all necessary specifications have been approved.
Made-to-order, custom, commissioned, trade, and commercial orders may require a deposit before production begins, with the remaining balance due upon completion and prior to shipment or delivery. The specific payment schedule, when applicable, will be provided at the time of purchase or outlined on the corresponding quote or invoice.
Deposits on made-to-order, commissioned, customized, or otherwise specially produced work are non-refundable once production has begun or materials have been purchased specifically for the order.
Ready-to-ship pieces require payment in full prior to shipment or delivery.
Unless otherwise agreed in writing or required by applicable law, made-to-order, commissioned, customized, limited-edition, discounted, and one-of-one pieces are considered final sale.
Lead Times
Rexach Studios is a small, independent studio, and much of our work is produced individually and by hand.
Estimated lead times for made-to-order pieces will be provided on the corresponding product page, order confirmation, quote, or invoice. Lead times may vary depending on the piece, current studio workload, order quantity, material availability, and the complexity of the work.
All production schedules, completion dates, shipping dates, and delivery estimates are provided as estimates rather than guaranteed deadlines unless expressly agreed otherwise in writing.
While every reasonable effort is made to complete work within the estimated timeframe, delays may occasionally occur due to material availability, supplier or vendor delays, shipping disruptions, weather, unforeseen fabrication challenges, or other circumstances outside the studio's reasonable control.
When a significant delay occurs, Rexach Studios will make reasonable efforts to communicate the change and provide an updated estimate.
For larger commercial, trade, or project-based orders, production schedules and delivery requirements may be established separately as part of the project agreement.
Material Availability & Design Modifications
All orders are subject to the availability of the materials, finishes, hardware, textiles, and other components necessary to produce the work.
Because Rexach Studios works extensively with natural materials and specialized components, exact materials may occasionally become unavailable, discontinued, delayed, or impractical to obtain.
If this occurs, Rexach Studios may recommend a comparable material of similar quality, appearance, and function. For any substitution that would meaningfully alter the appearance, performance, or character of the piece, reasonable efforts will be made to obtain client approval before proceeding.
Changes in material availability, supplier pricing, or other circumstances may also affect production schedules or, where applicable, the cost of work that has not yet been fully confirmed or placed into production.
The Handmade Nature of Our Work
Every Rexach Studios piece is produced with a significant degree of handwork and is intended to retain the character of the materials and processes used to create it.
Natural materials such as wood, stone, metal, glass, leather, and textiles may contain variations in grain, figure, color, texture, tone, markings, patina, and other characteristics. Hand-applied finishes, natural dyes, upholstery, joinery, and other handmade processes may also result in subtle differences from one piece to another.
These variations are inherent to handcrafted work and natural materials and should not be considered defects.
Product photographs, finish samples, material samples, renderings, and prototypes are intended to represent the overall character of a piece, but exact color, grain, texture, finish, and other naturally occurring characteristics cannot be guaranteed.
Dimensions may also vary slightly as a natural result of the fabrication process.
For projects involving multiple pieces, Rexach Studios will make reasonable efforts to maintain visual consistency across an order while preserving the natural variation inherent to the materials being used.
Custom & Commissioned Work
Rexach Studios welcomes opportunities for custom work, private commissions, trade projects, and creative collaborations.
Customizations may include modifications to dimensions, materials, finishes, upholstery, or other details of an existing design, as well as the development of entirely custom work.
Any specifications, dimensions, materials, finishes, pricing, design modifications, quantities, and estimated production schedules associated with custom or commissioned work will be established before production begins.
Depending on the scope of the project, drawings, renderings, samples, prototypes, or other design materials may be provided for review and approval.
The client, designer, architect, purchasing agent, or other authorized project representative is responsible for reviewing and approving all relevant specifications before production begins.
Once approval has been provided and a piece has entered production, requested changes may not always be possible. When changes can reasonably be accommodated, additional design, material, labor, or production costs may apply and the production schedule may be adjusted accordingly.
Custom and commissioned work is final sale unless otherwise agreed in writing or required by applicable law.
Customer's Own Material (COM/COL)
Rexach Studios may accept Customer's Own Material ("COM"), including upholstery fabric, or Customer's Own Leather ("COL") for certain custom and commissioned pieces.
All COM/COL must be approved by Rexach Studios before being shipped or delivered to the studio.
The studio may provide an estimated yardage, square footage, or material requirement based on the dimensions and construction of the piece. Unless otherwise stated, these estimates assume standard material widths, usable goods, and straightforward pattern placement.
Additional material may be required for fabrics or hides with large repeats, directional patterns, matching requirements, irregular dimensions, defects, limited usable areas, or other characteristics that affect cutting and upholstery.
Clients and their representatives are responsible for confirming the suitability, durability, performance, fire rating, treatment, composition, and intended use of any COM/COL they provide, including compliance with any requirements applicable to a particular residential, hospitality, commercial, or public environment.
Rexach Studios reserves the right to decline materials that the studio determines are unsuitable for the intended piece or fabrication process.
COM/COL should be clearly identified with the client's name, project name, and corresponding order or piece whenever applicable.
Rexach Studios is not responsible for manufacturing defects, dye-lot variation, color variation, incorrect quantities, undisclosed treatments, performance issues, or other characteristics inherent to client-supplied materials.
While reasonable care will be taken when handling COM/COL, Rexach Studios cannot guarantee replacement of rare, vintage, discontinued, one-of-a-kind, or otherwise irreplaceable client-supplied materials in the event of unforeseen damage during fabrication or handling, except where responsibility is imposed by applicable law.
Any unused COM/COL remaining after completion may be returned to the client upon request. Applicable packing and shipping costs are the responsibility of the client.
Trade, Commercial & Collaborative Projects
Rexach Studios welcomes relationships with interior designers, architects, galleries, hospitality groups, creative studios, purchasing agents, developers, and other professional partners.
Trade, commercial, hospitality, and larger project-based orders may be subject to additional terms specific to the scope of the project, including pricing, quantities, payment schedules, approvals, production timelines, delivery coordination, installation requirements, storage, and other project-specific considerations.
Where a separate written quote, proposal, purchase agreement, or project agreement has been issued by Rexach Studios, the terms of that agreement will govern the project where they differ from these general Terms & Conditions.
The person or organization placing the order is responsible for ensuring that all specifications, dimensions, materials, finishes, quantities, delivery requirements, and applicable project requirements have been reviewed and approved before production begins.
Rexach Studios is happy to collaborate directly with project teams when additional coordination is required.
Shipping & Delivery
Shipping and delivery arrangements will vary depending on the size, weight, value, quantity, and destination of the work.
Smaller works may be shipped through established parcel carriers. Larger furniture and other substantial pieces may be transported through specialized freight or white-glove delivery services.
Applicable shipping or delivery charges will be communicated during checkout, invoicing, or prior to shipment when they cannot reasonably be calculated beforehand.
All delivery dates and transit times are estimates. Rexach Studios is not responsible for delays caused by third-party carriers, freight providers, weather, transportation disruptions, construction delays, site conditions, or other circumstances outside the studio's reasonable control.
For furniture and oversized deliveries, the client or project representative is responsible for confirming that the delivery location can safely accommodate the piece. This includes appropriate vehicle access, loading areas, entryways, doorways, hallways, stairways, elevators, and any other conditions necessary to complete delivery.
Measurements and site conditions should be confirmed before ordering.
Additional costs resulting from restricted access, failed delivery attempts, special handling requirements, installation delays, or site conditions not disclosed prior to delivery may be the responsibility of the client.
Storage
Once an order has been completed, Rexach Studios will contact the client or project representative to arrange shipment, delivery, or pickup where applicable.
If a completed order cannot be accepted within a reasonable period after notification, storage fees may apply.
For project-based or commercial orders involving scheduled installations or coordinated delivery windows, extended storage requirements may be addressed separately within the corresponding quote or project agreement.
Any applicable storage fees will be communicated before they are incurred whenever reasonably possible.
Inspection & Damage Claims
Please inspect all work carefully upon receipt.
If a piece arrives damaged, contact Rexach Studios within 5 business days of delivery and provide a description of the damage along with clear photographs of the piece, its packaging, and any visible damage to the packaging.
For commercial or multi-piece deliveries, the receiving party should note any visible damage on the carrier's delivery documentation whenever possible.
Please retain all original packaging until the claim has been resolved, as carriers or insurers may require it for inspection.
Damage reported after this period may be more difficult or impossible to pursue with the carrier. Nothing in this provision limits any rights or remedies that cannot legally be waived under applicable law.
Warranty
Rexach Studios stands behind the craftsmanship of its work.
Unless otherwise stated for a particular piece or project, Rexach Studios provides a 12-month limited warranty against manufacturing defects, beginning on the date the piece is delivered.
This warranty does not cover normal wear and aging; natural variations in wood, stone, leather, textiles, metal, or other materials; changes in color, tone, texture, or patina resulting from age, light, environment, or use; characteristics or performance of COM/COL; misuse, abuse, accidents, or improper handling; damage resulting from improper installation or relocation; improper cleaning or maintenance; exposure to excessive moisture, heat, sunlight, weather, or unsuitable environments; or modifications, repairs, refinishing, or alterations performed by anyone other than Rexach Studios without prior authorization.
Because many of the materials used by the studio are intentionally selected for the way they develop character over time, natural aging and patina are considered part of the life of the piece rather than manufacturing defects.
If you believe your piece has a manufacturing defect, please contact Rexach Studios with photographs and a description of the issue so that it can be evaluated.
For commercial, hospitality, or other high-use environments, warranty terms may be established separately based on the intended application of the work.
Returns, Exchanges & Cancellations
Due to the handmade, limited-production, and often made-to-order nature of our work, all sales are final unless otherwise stated, agreed in writing, or required by applicable law.
Rexach Studios does not generally accept returns or exchanges for made-to-order, custom, commissioned, limited-edition, discounted, one-of-one, COM/COL, trade, or project-specific work.
Clients and project representatives are encouraged to carefully review all dimensions, materials, finishes, specifications, quantities, and delivery requirements before approving an order.
If you have questions about a piece before purchasing or approving production, please contact the studio beforehand.
If there is a problem with your purchase, please reach out. Although a return or refund may not be available, Rexach Studios is committed to the quality of its work and will make reasonable efforts to evaluate legitimate concerns and determine an appropriate solution.
International Orders
International clients are responsible for any customs duties, import taxes, tariffs, brokerage fees, or other charges imposed by the destination country.
These charges are not included in the purchase price or shipping cost unless expressly stated otherwise.
International shipping and delivery times may also be affected by customs processing or other circumstances outside the control of Rexach Studios.
Sales Tax
Applicable sales tax will be collected where required by law and calculated based on the order and delivery destination.
Tax-exempt clients, trade partners, or organizations may be required to provide appropriate resale or exemption documentation before an exemption can be applied.
Care & Use
Rexach Studios pieces are intended to be cared for in accordance with the materials and finishes used in their construction.
Care instructions may be provided with individual pieces or made available separately by the studio. Damage resulting from improper cleaning, maintenance, storage, environmental exposure, installation, or use is not considered a manufacturing defect.
Unless expressly stated otherwise, furniture and objects produced by Rexach Studios are intended for indoor residential use.
Pieces intended for commercial, hospitality, exterior, or other specialized environments should be identified as such before ordering so that appropriate materials and construction considerations can be discussed.
Intellectual Property
All designs, artwork, photographs, drawings, renderings, prototypes, graphics, text, product names, concepts, and other original material created by Rexach Studios remain the intellectual property of Rexach Studios and/or Brandon Rexach, as applicable.
The purchase or commissioning of a physical piece does not transfer any copyright, design rights, reproduction rights, manufacturing rights, or other intellectual property rights associated with that work unless expressly agreed otherwise in writing.
Rexach Studios designs and artwork may not be reproduced, copied, manufactured, commercially distributed, reverse engineered for reproduction, or used to create derivative products without prior written permission.
Drawings, renderings, prototypes, samples, and other design materials produced during the development of custom or collaborative work remain the intellectual property of Rexach Studios unless otherwise established through a separate written agreement.
Images and other content appearing on the Rexach Studios website or associated studio platforms may not be reproduced or used for commercial purposes without permission.
Photography & Project Documentation
Rexach Studios may photograph or otherwise document completed work for studio archives, portfolio use, publication, exhibitions, social media, and other promotional purposes.
For private residences, confidential projects, unreleased commercial spaces, or other situations where privacy or publication restrictions apply, those requirements should be communicated to Rexach Studios in advance.
Any project-specific photography, publication, confidentiality, credit, or embargo requirements may be established separately in writing.
Website Information
Rexach Studios makes reasonable efforts to ensure that product descriptions, dimensions, pricing, photographs, availability, and other information presented on the website are accurate.
Occasional errors or omissions may occur. Rexach Studios reserves the right to correct errors, update information, or cancel an order affected by a material pricing or listing error where permitted by applicable law.
Website colors may vary depending on screens, lighting conditions, photography, and the natural characteristics of the materials being represented.
Limitation of Liability
To the fullest extent permitted by applicable law, Rexach Studios will not be liable for indirect, incidental, special, or consequential damages arising from the purchase, delivery, installation, ownership, or use of its products.
Nothing in these Terms & Conditions is intended to exclude or limit liability or consumer rights that cannot legally be excluded or limited.
Changes to These Terms
Rexach Studios may update these Terms & Conditions from time to time to reflect changes in studio practices, services, legal requirements, or business operations.
The Terms & Conditions in effect at the time an order is placed will generally apply to that order unless otherwise agreed in writing or required by law.
